An Individual Flexibility Agreement is an employment contract between a single employer and employee that modifies the application of a modern award or enterprise agreement. It can used as long as you can satisfy the “better off overall” test. There is no requirement to register an individual flexibility agreement.
There were significant changes made to the Australian workplace relations system in January 2010, including the introduction of the National Employment Standards (NES) and the commencement of modern awards.
All contracts of employment, whether they are based on an award or not, must cover the National Employment Standards.
If you are an employer, you can be flexible with the Award conditions and the NES, and you can negotiate almost anything you like with an individual employee as long as you can demonstrate that the employee is better off over-all as a result of the bargain you strike.
Suitable for employees in situations where the employer is modifying the application of Modern Award provisions.
