The decision to live with ones partner is often made with little consideration to the rights that each person has with respect to money and property. A recent legal victory for same sex lobby groups has secured in legislation that same sex relationships are now recognised under Australian Law.
From the 1st March 2009 amendments to the Family Law Act 1975 recognise the validity of same sex relationships.
These laws provide for same sex couples, when they separate, to obtain property settlements on the principles that have applied to married couples since 1975.
These laws enable the Family Law Courts to order spousal maintenance and division of any property that the couple own, either separately or together including superannuation.
This means that even though a couple may not be legally married there is no discernible difference in the rights of the couple under the law, in a relationship of sufficient duration.
Sections 90UB and 90UC of the Family Law Act refer to financial agreements made before or during a de facto relationship.
In Western Australia these agreements are made under Sections 205ZN and 205ZO
of the Family Court Act.
